The use of the websites of Digital Beat GmbH is generally possible without providing any personal data. However, if an affected person wishes to use special services of our company via our website, processing of personal data may become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.

The processing of personal data, such as the name, address, email address, or telephone number of a data subject, always takes place in accordance with the General Data Protection Regulation (GDPR) and in compliance with the country-specific data protection regulations applicable to Digital Beat GmbH. Through this privacy policy, our company aims to inform the public about the type, scope, and purpose of the personal data we collect, use, and process. Furthermore, data subjects are informed about their rights through this privacy policy.

Digital Beat GmbH, as the data controller, has implemented numerous technical and organizational measures to ensure the most complete protection possible for personal data processed through this website. However, internet-based data transmissions can have security gaps, so absolute protection cannot be guaranteed. For this reason, it is free for each data subject to transmit personal data to us via alternative means, such as by phone.

2. Data Collection on Our Website

a. Server Log Files

When you access our website, information of a general nature is automatically recorded by our host (ALL-INKL.COM – Neue Medien Münnich, Owner: René Münnich, Hauptstraße 68, D-02742 Friedersdorf). This information (server log files) includes the type of web browser, the operating system used, the domain name of your internet service provider, and similar details. These are exclusively technical information that does not allow conclusions to be drawn about your person. This information is technically necessary in order to correctly deliver the requested content of websites and is mandatory when using the internet. Anonymous information of this kind is statistically evaluated by us in order to optimize our internet presence and the technology behind it.

b. Cookies

Like many other websites, we also use so-called „cookies.“ Cookies are small text files that are transferred from a website server to your hard drive. This automatically provides us with certain data, such as IP address, browser used, operating system through your computer, and your connection to the internet.

Cookies cannot be used to launch programs or to transfer viruses to a computer. Based on the information contained in cookies, we can facilitate navigation and enable the correct display of our web pages.

In no case will the data we collect be passed on to third parties or linked to personal data without your consent.

Of course, you can view our website without cookies as well. Internet browsers are regularly set to accept cookies. You can deactivate the use of cookies at any time via your browser settings. Please use the help features of your internet browser to find out how to change these settings. Please note that some features of our website may not work if you have disabled the use of cookies.

c. Contact Form

If you contact us by email or contact form, the information you provide will be stored for the purpose of processing the inquiry and for possible follow-up questions.

d. Provision of Paid Services
DigiStore24

We have outsourced part of our payment transactions to Digistore24 GmbH, St.-Godehard-Straße 32, 31139 Hildesheim. When making a payment through Digistore24, the following data is collected for order processing: first name, last name, email address, and billing address.

The data is initially stored due to a contract being concluded (e.g., ordering a product) until the statute of limitations expires. In accordance with commercial and tax law obligations (Art. 6 (1)c) GDPR), we also retain the personal data to be stored.

We have also outsourced our affiliate program to Digistore24, which allows for advertising reimbursement through the placement of advertisements and links to Digistore24. Digistore24 uses cookies to trace the origin of orders. Among other things, Digistore24 can recognize that you clicked on the affiliate link on this website. The storage of „Digistore cookies“ is based on Art. 6 (1) f) GDPR. The website operator has a legitimate interest in this, as only cookies allow the determination of the amount of his affiliate compensation. For more information and details on how your data is handled, as well as the privacy policy of Digistore24, please visit www.digistore24.com/legal/privacy.

Order Processing

In order to provide paid services, we may request additional data from you to ensure the fulfillment of the contract (Art. 6(1)(b) GDPR). For contract fulfillment, we transmit personal data to our service providers, transport, and shipping companies (Art. 6(1)(b) GDPR). The data is stored in accordance with commercial and tax obligations (Art. 6(1)(c) GDPR).

Your personal data for purchases and orders are necessary for contract processing, as a contract cannot be concluded without this data. For advertising purposes and interest-based advertising selection, we process your name, contact details, and criteria for advertising selection only until you object.

We use your name and possibly your address for further information about interesting products and services (Art. 6(1)(f) GDPR). For business customers, we use the phone number in case of presumed consent for telephone advertising (Art. 6(1)(f) GDPR).

e. Applications
If you send us data about yourself as part of an application (especially names, contact details, CV, cover letter, certificates, etc.), we store and process this data exclusively for the duration and execution of the application process. The legal basis for this is Art. 6(1)(b) GDPR. After the application process is completed, your data will be securely deleted. We do not share this with third parties. Only those individuals who need to know within the scope of the application process or employment relationship will have access internally.

Please note that we do not require information about race, ethnic origin, gender, religion or belief, disability, sexual identity, illnesses, pregnancy, political opinions, philosophical or religious beliefs, membership in a trade union, physical or mental health, or sexual life as part of your application.

3. Analysis Tools and Advertising

a. Google Analytics and Google Tag Manager (Including Anonymization)

Digital Beat GmbH has integrated the Google Analytics component on this website. Google Analytics is a web analysis service. Web analysis involves collecting, collating, and evaluating data about the behavior of visitors to websites. A web analysis service collects data, among other things, about which website a data subject came from to access a website (so-called referrer), which subpages of the website were accessed, or how often and for what duration a subpage was viewed. Web analysis is primarily used to optimize a website and to analyze the cost-benefit ratio of internet advertising.
The operating company of the Google Analytics component, as well as Google Tag Manager, is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

For web analysis through Google Analytics, the Data Controller uses the addition „_gat._anonymizeIp“ via Google Tag Manager. By means of this addition, the IP address of the data subject’s internet connection is shortened and anonymized by Google if access to our website is made from a member state of the European Union or from another contracting state of the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyze visitor flows on our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our websites, and to provide further services related to the use of our website.

Google Analytics places a cookie on the data subject’s information technology system. Cookies were explained above. By setting the cookie, Google is enabled to analyze the use of our website. Each time one of the individual pages of this website, which is operated by the Data Controller and on which a Google Analytics component has been integrated, is called up, the internet browser on the data subject’s information technology system is automatically prompted by the respective Google Analytics component to transmit data for the purpose of online analysis to Google. As part of this technical process, Google obtains knowledge of personal data, such as the IP address of the data subject, which Google uses, among other things, to trace the origin of visitors and clicks and subsequently to enable commission statements.

Using the cookie, personal information, such as the access time, the place from which access was made, and the frequency of visits to our website by the data subject, is stored. Each time you visit our website, this personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may share these collected personal data with third parties through the technical process.

You can prevent the setting of cookies through our website, as explained above, at any time by means of a corresponding setting in the internet browser used, and thus permanently object to the setting of cookies. Such a setting of the internet browser used would also prevent Google from setting a cookie on the information technology system of the data subject. In addition, a cookie already set by Google Analytics can be deleted at any time through the internet browser or other software programs.

Furthermore, it is possible for the data subject to object to the collection of data generated by Google Analytics that is related to the use of this website, as well as to the processing of this data by Google, and to prevent such collection. To do this, the data subject must download and install a browser add-on.

b. Google AdWords
Our website uses Google Conversion Tracking. If you have reached our website via an ad placed by Google, Google Adwords sets a cookie on your computer. The conversion tracking cookie is set when a user clicks on an ad placed by Google. These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of our website and the cookie has not yet expired, we and Google can recognize that the user clicked on the ad and was redirected to this page. Each Google AdWords customer receives a different cookie. Therefore, cookies cannot be tracked across the websites of AdWords customers. The information collected using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that personally identifies users.

If you do not want to participate in tracking, you can reject the required setting of a cookie – for example, via browser settings that generally deactivate automatic cookies or by setting your browser to block cookies from the domain „googleleadservices.com.“

Please note that you must not delete the opt-out cookies as long as you do not want tracking data to be recorded. If you have deleted all your cookies in the browser, you must set the respective opt-out cookie again.

c. Use of Google Remarketing
This website uses the remarketing function of Google Inc. The purpose of this function is to present interest-based advertisements to website visitors within the Google advertising network. A „cookie“ is stored in the visitor’s browser, which makes it possible to recognize the visitor when they access websites that belong to the Google advertising network. On these pages, visitors may be presented with advertisements that relate to content that the visitor has previously called up on websites that use Google’s remarketing function.

According to its own statements, Google does not collect any personal data during this process. However, if you still do not want to use Google’s remarketing function, you can generally deactivate it by making the appropriate settings at http://www.google.com/settings/ads.

Alternatively, you can deactivate the use of cookies for interest-based advertising through the Network Advertising Initiative by following the instructions at http://www.networkadvertising.org/managing/opt_out.asp.

d. Facebook Pixel
Our website uses the visitor action pixel from Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA („Facebook“), for conversion measurement purposes.

This allows us to track the behavior of site visitors after they click on a Facebook ad and are redirected to our website. This way, we can evaluate the effectiveness of Facebook ads for statistical and market research purposes and optimize future advertising campaigns (our legitimate interest).

The data collected is anonymous to us, and we cannot draw any conclusions about the identity of the users. However, Facebook stores and processes the data, so a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Usage Policy. This allows Facebook to display ads on Facebook pages as well as outside of Facebook.

We, Digital Beat GmbH, have no influence on the use of the data by Facebook in this context.

Click here if you do not want data to be collected via the Facebook pixel: www.facebook.com/settings.

Alternatively, you can deactivate the Facebook pixel on the Digital Advertising Alliance page under the following link: http://www.aboutads.info/choices/.

For more information on data collection and use by Facebook, your rights in this regard, and options for protecting your privacy, please refer to Facebook’s privacy policy at https://www.facebook.com/about/privacy/.

4. Newsletter

When registering to receive our newsletter, the data you provide will be used exclusively for this purpose.
Subscribers may also be informed via email about circumstances relevant to the service or registration (e.g., changes to the newsletter offer or technical conditions).

For effective registration, we require a valid email address. To verify that the registration is actually being carried out by the owner of an email address, we use the „double opt-in“ process. For this purpose, we log the order of the newsletter, the sending of a confirmation email, and the receipt of the response requested with it. No further data is collected. The data is used exclusively for newsletter delivery and is not shared with third parties.

Klick-Tipp

Some of our websites use Klick-Tipp for sending newsletters. The provider is KLICK-TIPP LIMITED, 15 Cambridge Court, 210 Shepherd’s Bush Road, London W6 7NJ, United Kingdom.

We have concluded a contract with Klick-Tipp for order data processing. This ensures that our service provider complies with the strict requirements of the GDPR when sending newsletters.

Klick-Tipp is a service that can be used to organize and analyze, among other things, the sending of newsletters. The data you enter for the purpose of subscribing to the newsletter will be stored on Klick-Tipp’s servers.

Data analysis by Klick-Tipp

When we send newsletters using Klick-Tipp, we can determine whether a newsletter message has been opened and which links, if any, have been clicked.

Klick-Tipp also allows us to categorize newsletter recipients into various categories (so-called tagging). Newsletter recipients can be divided, for example, according to gender, personal preferences (e.g., vegetarian or non-vegetarian), or customer relationship (e.g., customer or potential customer). This allows us to tailor the newsletters more effectively to the respective target groups. More information can be found at: https://www.klick-tipp.com and https://www.klick-tipp.com/handbuch.

If you do not want analysis by Klick-Tipp, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in each newsletter message.

Legal basis

Data processing is based on your consent (Art. 6 (1) (a) GDPR). You can revoke this consent at any time. The legality of data processing already carried out remains unaffected by the revocation.

5. Plugins & Tools

a. Use of Google Webfonts
To display our content correctly and graphically appealing across browsers, we use script libraries and font libraries such as Google Webfonts (https://www.google.com/webfonts/). Google Webfonts are transferred to your browser’s cache to avoid multiple loading. If your browser does not support Google Webfonts or prevents access, content will be displayed in a default font.
Calling script libraries or font libraries automatically triggers a connection to the library operator. It is theoretically possible – but currently unclear whether and for what purposes – for the operators of corresponding libraries to collect data.

You can find the privacy policy of the library operator Google here: https://www.google.com/policies/privacy/.

b. Security Plugin
We use the plugin „All In One WP Security & Firewall“ on our website. Due to security measures, IP addresses are stored to protect against Bruce Force attacks. Based on Article 6 (1) (f) GDPR (legitimate interest), we reserve the right to store this data for the purpose mentioned above.

c. Social Plugins
Social plugins from the providers listed below are used on our websites. You can recognize the plugins by the respective logo.

These plugins may send information, which may also include personal data, to the service operator and may be used by them. We prevent the unconscious and unwanted collection and transmission of data to the service provider through a 2-click solution. To activate a desired social plugin, it must first be activated by clicking on the corresponding switch. Only by activating the plugin is information collected and transmitted to the service provider. We do not collect personal data ourselves through social plugins or their use.

We have no influence on the data collected by the plugin or on how it is used by the provider. Currently, it must be assumed that a direct connection to the provider’s services is established and that at least the IP address and device-related information are collected and used. It is also possible that the service providers try to store cookies on the used computer. You can find out which specific data is collected and how it is used by consulting the privacy policy of the respective service provider.

Facebook

We use plugins from the social network Facebook on our websites, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. If you visit a page on our website that contains such a plugin, your browser establishes a direct connection to the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser and integrated into the page. Through this integration, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook profile or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can directly assign your visit to our website to your Facebook profile. If you interact with the plugins, for example, by clicking the „Like“ button or leaving a comment, this information is also transmitted directly to a Facebook server and stored there. The information is also published on your Facebook profile and displayed to your Facebook friends.

The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your related rights and setting options to protect your privacy, can be found in Facebook’s privacy policy: https://www.facebook.com/policy.php.

If you do not want Facebook to assign the data collected via our website directly to your Facebook profile, you must log out of Facebook before visiting our website. You can also completely prevent the loading of the Facebook plugins with add-ons for your browser, e.g. with the „Facebook Blocker“ (https://webgraph.com/resources/facebookblocker/).

Instagram

The data controller has integrated components of the Instagram service on this website. Instagram is a service that qualifies as an audiovisual platform and allows users to share photos and videos and also to disseminate such data in other social networks.

The operating company of the Instagram services is Instagram LLC, 1 Hacker Way, Building 14 First Floor, Menlo Park, CA, USA.

Every time you access one of the individual pages of this website, which is operated by the data controller and on which an Instagram component (Insta button) has been integrated, the internet browser on your information technology system is automatically prompted by the respective Instagram component to download a representation of the corresponding component of Instagram. As part of this technical process, Instagram is informed about which specific subpage of our website is visited by you.

If you are logged in to Instagram at the same time, Instagram recognizes which specific subpage of our website you visit with each visit to our website and for the entire duration of your stay on our website. This information is collected by the Instagram component and assigned to your Instagram account. If you click on one of the Instagram buttons integrated on our website, the data and information transmitted with it are assigned to your personal Instagram user account and stored and processed by Instagram.

Instagram receives information through the Instagram component that you have visited our website whenever you are logged in to Instagram at the same time as you access our website, regardless of whether you click on the Instagram component or not. If you do not want this information to be transmitted to Instagram, you can prevent it from being transmitted by logging out of your Instagram account before accessing our website.

For more information and the applicable privacy policy of Instagram, please visit https://help.instagram.com/155833707900388 and https://www.instagram.com/about/legal/privacy/.

Twitter

We use Twitter buttons on our homepage. Twitter is a microblogging service provided by the American company Twitter, Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107.

When you click on the Twitter buttons and „tweet“ information via the opening Twitter window, you transmit the tweeted information to Twitter. This information is then published in your Twitter user profile.

For more information on data collection, evaluation, and processing by Twitter, as well as your related rights, please refer to Twitter’s privacy policy, which can be found at http://twitter.com/privacy.

Vimeo

Our websites use plugins from the video portal Vimeo. The provider is Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.

When you visit a page with a Vimeo plugin, a connection to Vimeo’s servers is established. Vimeo is informed which of our pages you have visited. Vimeo also obtains your IP address. This also applies if you are not logged in to Vimeo or do not have an account with Vimeo. The information collected by Vimeo is transmitted to the Vimeo server in the USA.

If you are logged in to your Vimeo account, you allow Vimeo to associate your surfing behavior directly with your personal profile. You can prevent this by logging out of your Vimeo account.

For more information on how user data is handled, please refer to Vimeo’s privacy policy: https://vimeo.com/privacy.

YouTube

On some of our websites, we embed YouTube videos. The operator of the corresponding plugins is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit a page with the YouTube plugin, a connection to YouTube’s servers is established. This tells YouTube which pages you are visiting. If you are logged in to your YouTube account, YouTube can associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account beforehand.

When a YouTube video starts, the provider uses cookies that collect information about user behavior.

If you have deactivated the storage of cookies for the Google Ad program, you will not have to expect such cookies when watching YouTube videos. However, YouTube also stores non-personal usage information in other cookies. If you want to prevent this, you must block the storage of cookies in your browser.

This privacy policy was created with the help of the privacy policy generator of activeMind AG, as well as by DGD in cooperation with RC GmbH and the file sharing attorneys of WBS-LAW.
